Terms & Conditions

By scheduling an appointment with NEA Mobile Notary, you agree to the following terms and conditions. These policies are intended to provide clear expectations for scheduling, fees, travel, cancellations, notarial requirements, and payment.

Notary Services

NEA Mobile Notary provides mobile notary services in accordance with Arkansas notary laws and regulations. A notary public acts as an official and unbiased witness to the identity of the person appearing before the notary. Arkansas requires the signer to personally appear before the notary at the time of notarization.

Notary services may include acknowledgments, jurats, oaths, affidavits, and other notarial acts permitted under Arkansas law. NEA Mobile Notary does not provide legal advice, does not prepare legal documents, and does not determine which notarial act is required for your document. If you are unsure what type of notarization you need, please contact the receiving agency, document preparer, or an attorney before your appointment.

Arkansas Notary Requirements

All signers must be physically present, willing to sign, and able to communicate directly with the notary. Each signer must provide satisfactory proof of identity. The Arkansas Secretary of State recommends a government-issued identification card that includes the signer’s picture and signature, such as a driver’s license or passport.

NEA Mobile Notary may refuse service if the signer cannot be properly identified, appears unwilling or unable to understand the transaction, is not physically present, appears to be under duress, or if the document or circumstances raise legal, ethical, or safety concerns. Arkansas notaries are not required to notarize every document presented to them.

For a notarization to be complete, the document must include proper notarial wording, such as an acknowledgment or jurat statement. Arkansas guidance states that a complete notarization must include a certificate describing the act witnessed, including where, when, who signed, what the notary witnessed, and the notary’s credentials.

Fees & Travel Charges

All fees will be disclosed before the notarial act is completed. Under Arkansas law, a notary public may charge a reasonable fee for a notarial act as long as the fee is disclosed to and agreed upon by the client or principal before the notarization is performed.

Fees may include, but are not limited to:

Notarial act fees

Mobile travel fees

After-hours, weekend, or holiday appointment fees

Printing or document handling fees, if applicable

Waiting fees or late arrival fees

Cancellation or no-show fees

Travel fees are separate from notarial act fees and are charged for the time, mileage, and convenience of mobile service. NEA Mobile Notary’s travel fees are set below the current federal mileage reimbursement rate.

Scheduling & Booking

Appointments are scheduled based on availability and are not guaranteed until confirmed. Clients are responsible for providing the correct appointment location, contact information, number of signers, type of documents, and any special circumstances before the appointment.

Please have all documents ready prior to the appointment. Documents should be complete, unsigned unless signing in front of the notary is required, and accompanied by valid identification for each signer.

NEA Mobile Notary is not responsible for delays caused by incomplete documents, incorrect addresses, missing signers, invalid identification, lack of required witnesses, or failure to know what type of notarization is needed.

Late Arrival, Waiting Time & Missed Appointments

Clients are expected to be ready at the scheduled appointment time. A grace period may be provided at the notary’s discretion.

If the signer, documents, witnesses, identification, or required parties are not ready at the scheduled time, a waiting fee may apply. If the appointment cannot be completed due to client delay, missing identification, incomplete documents, absent signers, or refusal to proceed, the client may still be responsible for travel, waiting, booking, or appointment-related fees.

If the client is not present or cannot be reached at the appointment location, the appointment may be considered a no-show. No-show appointments are non-refundable.

Cancellations & Rescheduling

Appointments should be canceled or rescheduled as early as possible. Same-day cancellations, last-minute cancellations, or cancellations made after the notary has begun traveling may still be subject to travel, booking, or appointment fees.

Rescheduling is subject to availability. Fees previously paid may not transfer to a new appointment unless approved by NEA Mobile Notary.

No Refund Policy

All payments are final. NEA Mobile Notary has a no-refund policy under any circumstances, including but not limited to canceled appointments, missed appointments, signer refusal, lack of acceptable identification, incomplete documents, incorrect notarial wording, document rejection by a third party, or failure to obtain required witnesses.

Payment is for the notary’s time, travel, availability, and services rendered or attempted. NEA Mobile Notary cannot guarantee that a document will be accepted by any agency, lender, court, business, or receiving party.

Payment Methods Accepted

Payment is due at or before the time of service unless otherwise agreed in writing. Accepted payment methods may include:

Apple Pay

Cash App

Zelle

PayPal

Returned payments, chargebacks, or unpaid invoices may result in additional fees and refusal of future services.

Notary Journal / Recordkeeping

Arkansas law does not require a notary to keep a record of official acts, but the Arkansas Secretary of State recommends maintaining a register or journal. A journal can help document what occurred during a notarization and may be useful if the notary is later asked to testify or verify a past notarial act.

NEA Mobile Notary may maintain an optional notary journal or record of services performed, which may include the date, type of notarial act, document type, signer name, identification method, fee information, and signer signature where appropriate.

Identification & Witnesses

Each signer must provide valid and satisfactory identification. If witnesses are required, the client is responsible for providing qualified witnesses unless arrangements are made in advance. Witnesses must also provide valid identification when required.

NEA Mobile Notary does not determine whether witnesses are legally required for a document. The client is responsible for confirming witness requirements with the receiving agency, document preparer, or attorney.

Document Responsibility

Clients are responsible for ensuring that documents are complete and ready for notarization. NEA Mobile Notary cannot explain legal effects, choose notarial wording, draft documents, complete documents on behalf of a client, or advise whether a document is legally sufficient.

A notary may complete the notarial certificate but cannot leave required notarial certificate blanks incomplete for someone else to fill in later. Arkansas guidance states that the notary’s certificate should be completed by the notary before it is signed and sealed.

Service Area & Travel

NEA Mobile Notary provides mobile notary services in the agreed service area. Travel outside the standard service area may be available for an additional fee. Travel fees may vary based on distance, time, location, after-hours requests, weather, traffic, parking, facility access, or urgency.

Hospitals, Nursing Homes & Care Facilities

For appointments at hospitals, nursing homes, rehabilitation centers, assisted living facilities, or care facilities, the signer must be alert, willing, aware, and able to communicate directly with the notary. Facility staff may not control the signing process or answer for the signer.

If the signer is not able to proceed at the time of appointment, the notarization may be refused, and applicable travel or appointment fees may still apply.

Right to Refuse Service

NEA Mobile Notary reserves the right to refuse or stop service for any lawful reason, including concerns about identification, willingness, awareness, fraud, coercion, incomplete documents, unsafe conditions, inappropriate behavior, or requests outside the scope of Arkansas notary law.
